The Supreme Court has affirmed Barrister Caleb Mutfwang (PDP) as duly elected and returned as Governor of Plateau State in the 18th March Governorship poll.
The tribunal had unanimously affirmed Gov Mutfwang as Governor upon the petition of the APC Candidate, Goshwe Yilwatda Nentawe.
However, the Court of Appeal upturned the judgement and sacked the Governor.
Gov Mutfwang approached the Apex Court who held:
Plateau state high court order can’t affect PDP primaries because primaries is conducted by National Executive Committee of the Party not state.
The court of Appeal lacked the jurisdiction to hear the issue of nomination.
Issue 2 resolved in favour of PDP. They lacked locus standi in the internal affairs of another party.
Issue 3, whether judgment in Bitrus Kaze can stop the nec of the party from conducting primaries.
The Apex Court also had very harsh words for the Appeal Court for dabbling into matters it had no Jurisdiction over.
